because it isn’t a thing.
it would not have created a constitutional ‘crisis’. the constitution is clear.
yes, it would have created a great constitiutional issue, mostly because it never happened before.
it would have got to scotus tout de suite.
and scotus would have likely said “wtf does ‘send them back to the States’? even mean?”
