I share everybody’s absolute disgust for Kavanaugh.

But even from a cold-blooded political calculation point of view, it seems kind of crazy to me that the GOP is still pushing Kavanaugh.

As mentioned earlier, if he gets in, he now has criminal liability for sexual crimes with a minor in the State of Maryland. As well as for perjury in his Congressional testimony. And the GOP will not keep the Senate forever.

I am wondering if he will even be able to keep his federal judgeship if he backs down on SCOTUS.

As noted in the past, the sex crime (attempted rape) statute of limitation has expired. The law passed removing that limitation was passed after the time of the accusation, thus it would be unconstitutional to prosecute for the crime of attempted rape (ex post facto law).

On the other hand, there was never a statute of limitation on the crime of kidnapping (the lesser included offence in rape and attempted rape). The constitutional hurdle would be much easier with a charge of kidnapping.
