I disagree guys. Scalia doing this is a no brainer but Kennedy was furious when the anti-gay marriage lawyer made some crappy arguments. I think the court will get this one right. I also don’t think Roberts wants go down in history as someone who affirmed modern Jim Crow.

I do wonder how much umbrage these justices take when some lawyer in front of them starts making really crappy and/or illogical arguments. It’s essentially a professional insult to those sitting on the highest court in the land and who have reached what has to be the pinnacle of their legal careers.
