Well, it is The Telegraph.
Saw Sandy and Lonnie Phillips, parents of one of the Aurora shooting victims on Maddow. They lost a lawsuit against the online retailers who sold Holmes ammunition and magazines, and have been ordered by a court to pay $280,000 in defendant’s attorney fees because of a law that protects the firearms industry from such suits.
I feel bad for the Phillips but one thing struck me as somewhat deceptive about the narrative being presented. The fact is that any brick and mortar retailer would have sold Holmes the same ridiculous shit with the same no questions asked policy. Focusing on the online aspect of the sales seems irrelevant in that regard, and is only there to present the idea that there’s some kind of loophole that was exploited when there really wasn’t. I mean, I get what they’re doing, creating a wedge issue, but the dishonesty is a little off-putting.
Looking into what Holmes bought the only thing that stands out as actually legally dicey is the M7A3 tear gas grenades, because the striker type fuzes were ruled explosives by the ATF in 2011 and Holmes carried out his attack in 2012. However if he bought them before the rule change it again would not have mattered whether the retailer was online or brick and mortar, the same who gives a shit attitude pervades the entire industry. That is what we need to deal with head on, and treating grown ass adults like we are idiots who might not support a cause enthusiastically without a red herring appetizer is one of those cynical tactics I’ve come to expect from conservatives. It looks bad on legitimately aggrieved victims of gun violence.
Whatever, I feel like their lawyer just took their money to fight a case with zero chance of success, costing them what looks like the entirety of their net worth, and gained little to nothing by way of PR value. These people were probably out of their minds with grief, and I commend them for remaining resolute in the face of their defeat, but there had to have been a more effective path an ethical attorney could have advised them to take.

What is interesting Charles is how good images nowhere near the 500k limit look. That moon pic is only 220. I don’t think it gets a lot better if I dial it up to close to the limit. Thing is, EC, in this case the Protection of Lawful Commerce in Arms Act (PLCAA) served a good purpose, whatever you think about guns.
As evidence, I offer the order from Senior District Judge Richard Matsch when he awarded the defendants in the lawsuit $203,000 in attorney’s fees. as Judge Matsch makes clear, the plaintiffs were not asking for monetary damages; They were asking the court for the following:
“The injunctive relief requested is to stop all the defendants’ commercial activities until their business practices have been changed and approved by the court. There is nothing in the record to indicate that the plaintiffs or the Brady Center, the apparent sponsor of this case, made any attempt to persuade the defendants to make any alterations of those practices before bringing this highly publicized lawsuit,”
That line and others like it make clear that the Brady Campaign was asking the judge to legislate and regulate from the bench. Judge Matsch refused because the changes sought were not the job of the courts to create or administer. The job of making the law belongs to the legislature, and that of drafting regulations to enforce the law to the executive. That the legislature (in this case the US Congress) has declined to pass such laws does not mean the courts may do so.
Now, I know some people are going to not like my making a Separation Powers Argument here, but its the right argument to make and it is ultimately the argument at the heart of the PLCAA. If the legal and regulatory situation is not unconstitutional, then it is not the place of the courts to change it. For the courts to do so greatly oversteps their constitutional role.
Note: This last paragraph should not be read as my having said the courts should not act in civil rights cases. In such cases, the argument is that the current legal or regulatory situation violates the Constitution, and so it is entirely proper for the courts to intervene.

I can remember in college going to head shops in the mountains (Crested Butte, Carbondale) and there were signs at the entrance. “No Use of any marijuana-related paraphernalia terms. You know what we’re talking about. Any use of these terms is grounds for immediate ejection.”
Like I said, it used to be like that.
They keep a ledger at the one I go to. If you buy say NOx or amyl nitrate you have to put in your personal information which the local police can stop in any time and take or copy.

I really really really really hope Obama pulls off a massive “October Surprise” right before the 2016 election and just signs a stinkin’ executive order that removes cannabis from the Controlled Substances Act of 1970’s Drug Schedule entirely, thus making cannabis legal for possession and consumption for adults nationwide.
Cannabis is Schedule 1, the worst one.
The drug has a high potential for abuse. The drug has no currently accepted medical use in treatment in the United States. There is a lack of accepted safety for use of the drug under medical supervision

Yesterday I posted a story about how a NJ State Trooper in Sparta opened fire on 3 teens who had mistakenly knocked on the home, getting the address wrong for a friend.
There’s some new details, including that the teens were detained for 9 hours before being released without being charged. The officer so far has not been subject to any discipline.
Oh, and the gun he used had a laser sight, and that was the first indication to the teens that something was amiss.
Trooper Kissinger Barreau told investigators he believed the teens were trying to break into his Sparta home, CBS New York reported. Police said they are investigating the shooting, but Barreau remains on active duty and hasn’t faced any charges.
One of the teens, 18-year-old Jesse Barkhorn, said he and his friends were dropping people off after a party Sunday. They mistakenly knocked on the trooper’s door, having mistaken it for a friend’s house, around 2 a.m., then ran back to their car after they heard a man screaming at them through the door.
As they turned their car around a cul-de-sac, they noticed a red dot following them in the darkness — and realized it was the laser sight of a firearm. Then they saw Barreau standing outside with his personal gun.
“At this point we’re freaking out, ‘It’s a gun, it’s a gun,’ ” Barkhorn said.
“I was like, ‘Dude, get out of here.’ “
As they drove away, the trooper gave chase and fired at least three shots at them, with one hitting the car’s front tires.
The cop says that he identified himself as a cop, but the teens say they never heard it since their windows were rolled up - and were trying to get away from a crazy dude who was pointing a gun at them.

There was a cop funeral here in the bay area yesterday for a Hayward police officer who was killed in the line of duty. A miles-long funeral procession was followed by a service at Oracle Arena with 5000+ in attendance. Very impressive and very emotional but it makes me very conflicted regarding the police when I see something like that in contrast to totally unjustified murders of so many people by members of other police departments. Not only do these victims not get services like that, all too often, they can’t even get the justice they deserve. Something is very wrong in the country when its no longer clear who is the bad guy.

I gotta run to work but did you see the Page here about why cops from elsewhere don’t shoot like US cops? It’s the training. Lots more perhaps twice over. Screening and training that in some ways never ends is what seems to be the difference. We don’t have this huge group of awful human beings. We have bad apples, a bad culture, but all came from specific dangerous inadequacies. Lots of them.

Thing to remember is that even by their standards he’s a loser. He’s already been convicted of a hunting violation here in Wisconsin that is, essentially, poaching (killing a black bear 40 miles outside of where he was licensed to do so). I’d rather only hunt for food but by the same token in some African nations much of the conservation budget comes from hunters and the culling that is necessary in the preserves happens that way as well. Combine that with the economic value and food value for the locals? I may not be interested in doing that kind of hunt, but I will not begrudge someone who does it ethically. t

So, I found the miniseries Selling Hitler, all five parts, on YouTube, and it’s quite good - I’d never seen it before and I recommend it.
In a nutshell, the miniseries is based on the eponymous book by Robert Harris which deals with the infamous ‘Hitler Diaries’ hoax; one of the best examples of how journalistic integrity went right out the damned window in the pursuit of “the scoop of the century”.
Amazingly, even though they were crude forgeries, they briefly fooled Eberhard Jäckel and Hugh Trevor-Roper, though both later realized the ‘diaries’ were a fraud.

USPS? Priority mail small flat box is $6, and of course it won’t hold anything and it’s a 2-3 day shipment - clearly you can’t ship any living tissue THAT way.
If you want to send it FedEx overnight, a 10 lb box will cost you over $100.
You are correct. I sometimes ship snakes overnight via FedEx, and it’s very expensive.

Both officers made comments at the scene but later were interviewed in depth by Cincinnati police officers about what they had witnessed, Deters said Friday.
Deters said in official interviews, neither officer said that they had seen Tensing being dragged as the initial incident report stated and both officers also testified in front of the Hamilton County grand jury.
“I fully agree with the decision of the Hamilton County Grand Jury. These officers were totally cooperative in the investigation and consistent in their statements,” Deters said. “There was some confusion over the way the initial incident report was drafted but that was not a sworn statement by the officers and merely a short summary of information.
“When the officers were specifically asked about what they saw and heard, their statements matched Tensing’s body camera video. These officers have been truthful and honest about what happened, and no charges are warranted.”
