It’s why even though I never thought he was stupid, I always thought Scalia was a shallow thinker. Although Thomas is the one who is more of an Originalist. Wouldn’t call him dumb either but I do think originalism is a conservative way of trying to use the old logic trick of speak for authority even though they know the Founders’ exact intents as much anyone else who has read The Constitution. IT’s a very arrogant philosophy. But it fits with how conservatives interpret documents, see scripture.

I really hate who he surrounds himself with. I don’t have much optimism in him having a good team around him. Warren I concede is probably a little more ambitious than I am on economic reform but I believe she would surround herself with a good team. I haven’t found one Bernie surrogate that has really made me like him. Just a bunch of people who want me to ignore Bernie’s own problems and act like everyone else is a sell out but him.

The tweet seems to be gone. Probably because the “cede Russia to Putin” line.

Originalism is nothing more than right wing judicial activism by another name.

It’s bulkshit. It’s not literalism. It’s not the plain language of the Constitution. It’s whatever the right wingers want it to mean. It’s entirely results oriented - they have the result in mind, and this is how they’d justify it.

“When I use a word,’ Humpty Dumpty said in rather a scornful tone, ‘it means just what I choose it to mean — neither more nor less.”
“The question is,” said Alice, “whether you can make words mean so many different things.”
“The question is,” said Humpty Dumpty, “which is to be master— that’s all.”

It’s not even an honest Ouija board session. Instead these clowns decide all their cases as they please, and justify it in their opinions by pretending the founders would agree with them.

A moderately literate 4th grader could do exactly the same.

Bolton is a Republican, therefore he is a turd. He may be a temporarily useful turd, but that’s the most we can expect unless/until a change of party complete with contrition, remorse and substantial acts of atonement.

God that’s stupid. What part of the president being impeachable for disobeying Congress do these fuckwits not get?

If Congress appropriates foreign aid and this aid is enacted into law, the president has no right to unilaterally not do that later on, and the only available remedy for presidential defiance on this point is impeachment and removal from office.

Demanding that there be meta-law that specifically states that the US president has to act according to the laws passed by Congress is the stupidest thing ever.
