SCOTUS rejects students’ American flag free speech appeal

On Cinco de Mayo in 2010, three white students came to Live Oak High School in American flag T-shirts. Because the school has a history of gang violence between whites and Hispanics, school officials were afraid the shirts would anger Hispanic students celebrating the Mexican holiday and told the white students to either turn their shirts inside out or take them off.

The Supreme Court justices did not comment on their decision to reject the appeal in Dariano v. Morgan Hill Unified School District and leave the ruling from the 9th Circuit Court of Appeals in place.

The appellate judges held that, given the history of prior events at the school, including an altercation on campus, it was reasonable for school officials to proceed as though the threat of a potentially violent disturbance was real.

Despite arguments from the students’ parents that the school violated their children’s First and 14th amendment rights, the judges held that school officials anticipated violence or substantial disruption of school activities and their response was tailored to the circumstances.

This was the right ruling. I don’t like that the school had to ban American flag clothes, even for a day, but that’s better than a major fight breaking out and people getting hurt or killed.

Just because Indiana used the same name for their legislation doesn’t mean it is the same as the federal or other states RFRAs. Only way to tell difference is to read and compare the versions.

And anyone who reads them would have no choice but admit that Gov. Pence and the GOP are trying to pull a fast one by inserting this language that enables discrimination.

Frankly, RFRA’s balancing test is, if anything, only a mild protection. From the First Amendment alone, we should understand (in my opinion) that the nation’s traditions of religious freedom should protect the right of a traditional Christian baker not to make a cake for a same-sex marriage. It should protect the right of a Muslim baker not to provide unleavened bread for a Jewish seder. It should protect the right of a homosexual photographer to decline to take photos of a married couple standing under a Biblical inscription about marriage being between man and woman. It should protect the right of a Jewish deli owner to deny services to a Muslim hungry from a demonstration march where the Muslim held aloft a sign saying “Death to Israel and Jews.”

No law says you have to serve someone who threatens you. If the Deli owner refused to serve this guy, but served other Muslims, then no problem. If he refuses to serve any Muslim, that’s discrimination.

Also, trying to wrap my head around the second example. Why would any baker produce unleavened bread for and not sell it to Jews. I mean there are very specific kosher regulations on how Passover Matzo is made. This hypothetical Muslim baker would have had to have gone through the Kosher certification process, and then produced matzo specifically for the purpose of not selling it to Jews. That’s a lot of work just to be a dick.

Now mind you, I think it’s an extremely bad law, and should never have been passed, but the difference between the federal RFRA and these new state laws in Texas and Indiana, etc. is that the federal law discriminates in favor of certain groups, while the new laws discriminate against certain groups.

The Indiana RFRA is welcome. But it is weak, and will fall in front of the storm. As predicted by a friend in a recent Facebook post, at some point in the near future, within 1 - 5 years by my own reckoning, the RFRA laws, federal and state, will be overthrown in a Supreme Court decision. This will surprise only those who have lived with their heads under rocks, for it will be the logical outcome of the Court’s long jurisprudence of sexual individualism.

We are at war. It is a war we did not wish, but it is thrust upon us. And the sooner we realize it, the sooner we can raise the barricades. We must take every opportunity in law to argue against the eventuality. But we should not expect the law to do much for us any longer. There are those who will say that what is written here is “divisive” or seeks no compromise. This is untrue. For we must compromise, if only to hold the peace as long as possible, while we form communities and keep alive what tradition and religion we can. But, while we will not breach the compromise (laughably, the RFRA is seen as such by many!), it will certainly be broken. The fleeting withdrawal from the federal RFRA has shown us as much. And the refusal to read and understand - this law, our religious faiths, the philosophy of the West - is evidence that compromise may be possible only for a little while longer.

They just can’t help themselves with that whole “Damn your sexual individualism!!!! …and stop thrusting on us!!!! No really…you can stop in a couple of minutes…”

Father of MPHS shooter arrested

Basically the NICS check failed to pick up the father’s active restraining order, because the Tribal Courts apparently aren’t tied into the system. Because of this the guy was successfully able to purchase five guns in separate FFL transactions over the course of several months and keep those guns for years until his son killed a bunch of kids with one of them.

I can kind of understand why Tribal Court orders weren’t checked before now, because they’re ostensibly a separate kind of jurisdiction with limited sovereignty. Because of that this is exactly the kind of oversight one would expect to occur. But there’s obviously a lot of overlap between life on and off the Reservation, and this systemic failure has served to totally undermine the ability of the Tulalip Tribe to regulate it’s own members, keep them safe and administer justice. This needs to get fixed, soon.

Is that suddenly a crime?

This is not the first time that a branch of the government has reached into my chapel and punished me for my sermons. It also happened when I was a chaplain in the Navy in 2005. That unlawful punishment helped launch 300,000 petitions and I was eventually vindicated by Congress, because their voters demanded religious freedom.Will we?

It’s all part of the same movement, about “religious freedom”.

The government is now forcing me to choose between obeying God on Sunday, and representing the people Monday through Friday. […]

I suspect this is going to become more and more commonplace in our politics.
