I appreciate the judges concerns, but how he makes a public safety issue out of a 'maybe' down the road is going a bit far.

Unless the judge has hard evidence to show that gender reassignment is directly related to increased felony behavior, he is way out of line.

And he is misusing science to further an idiotic agenda.

I'm just glad Johnny Cash isn't around...

You know, I was kind of rolling with the judge's logic, thinking this is an interesting decision then the judge goes and uses Genesis in his opinion and that's all she wrote.

Obviously this asshole is just pandering to wingnuts. Maybe he plans to run for the Oklahoma Supreme Court like the "Ten Commandments" Judge Roy Moore did in Alabama.

While I may agree that a “sex change” doesn’t make someone the opposite sex I think it has zip to do with changing your name

In most states, gender re-assignment surgery does actually confer the legal status of the opposite sex. Vaginaplasty and labiaplasty create a functional and sensate female sex organ, although pregnancy is not possible due to the absence of ovaries.

You should also know that actual DNA is no guarentee of physical gender, since AIS women are technically males with an xy chromosome, but never develop male sex organs and are women to all appearances. This is often not discovered until puberty onset when the girl never starts a period. In some cases, it is not discovered until the women in question is married and tries to find out why she cannot get pregnant. No ovaries or fallopian tubes along with having an xy chromosome is why. It seems that external female genetalia is the biological default option, and if the embryo does not get male hormones at a crucial time in pregnancy or for some reason cannot respond to male hormones, then the child will develop as a girl.

I fail to see how denying a law-abiding adult person's desire to change their name to something they want to be called makes sense, Genesis or no Genesis.

re: #5 SanFranciscoZionist

I fail to see how denying a law-abiding adult person's desire to change their name to something they want to be called makes sense, Genesis or no Genesis.

The judge wrote: “Here, petitioner has not even had the surgery by which his sex purports to be changed.

I assume in these cases a person has to go through a long process of gender identity re-assignment and they get through this supervised treatment IDs etc that allow them as men to use female bathroom facilities without getting arrested. The decision read as if the person was requesting the name change did not go through that and was requesting the female name might hint at fraud: “To grant a name change in this case would be to assist that which is fraudulent”

But then judge inserted Genesis in his opinion and I realized that the judge was not trying to maintain the integrity of the gender re-assigning procedure but to make a religious point.

What's next, parents can't name their male baby "Jamie" or "Kim" because "THOSE ARE GIRL'S NAMES!!!"?

If a parent can legally name their child all the fucked-up names that celebrities tend to come up with (examples: Apple, Bronx Mowgli, Banjo, Camera, Cannon, Pilot Inspektor, Pirate, Rocket, Moxie CrimeFighter) how can you prevent someone from changing their name to whatever the fuck they want to?

Parents get to impose whatever crazy name they want on their unwilling children (other than that one case where the racist redneck couple named their kids Hitler and White Power), but if that (now grown-up) kid wants to change their name to one typically used by the other sex.....that's not allowed?

“To grant a name change in this case would be to assist that which is fraudulent,” Graves wrote. “It is notable that Genesis 1:27-28 states: ‘So God created man in his own image, in the image of God created he him; male and female created he them. And God blessed them, and God said unto them, be fruitful, and multiply, and replenish the earth …’ The DNA code shows God meant for them to stay male and female.”

Your (dis)honor, this apparent disregard for church-state separation implies that you don't give a damn about "that which is fraudulent," as you are clearly cherry-picking which laws to uphold. GTFO of the courthouse, you shameless theocratic bigot!
