The bill itself doesn’t sound as bad as what Markey says about it. It would produce a study to see if hate crimes are incited by use of telecommunications. And it’s an update to a previous study:

The NTIA last did such an analysis in 1993

See, I am too, but I’ve been paying attention. I’ve noticed that we are the people who talk the most about how we need to soothe and pacify, how we shouldn’t do this sort of thing.

We, you and me and other straight white males, we don’t get attacked just because we’re SWM. We don’t catch slurs and sit and wonder if this is ‘just talk’ or ‘incitement’. We don’t have to wonder if we’ll know if/when that mob starts coming at us.

And that, sir, explains the restriction. The government is allowed to restrict some speech, as shown in case after case. You cannot defame, and you cannot incite violent action.

There’s a flip side here. See, we can act to restrain the speech OR we can level the playing field (again) and say that hate speech is fighting words. Allow the use of the words be an invitation to, well, pre-emptive violence on the part of those the words are directed against.

That is, frankly, even more stupid. The constitution says its purpose is to, among other things, “insure domestic tranquility”.

Yes, that’s right. The constitution does indeed contain a phrase that can be read as allowing restrictions on other parts of it. Heck, the whole document is a design of tension. Everything has a check and balance.

That said, let me dismiss the last of Mr “I’m a Fox Liberal” Colmes - that this will hurt the Democrats in upcoming elections.

Balls. Oh, gee, it’s going to make the political opposition - the ones who use this hate speech - mad. They’re going to get riled and come to the polls. So tell me, how much more is it going to do than the ACA and Gay Marriage and Black President? Hmm?

Answer, none. So instead of asking about firing up the other side, why not ask about firing up the dem side? Show that dems aren’t pablum on the race and hate issue. Show that they’re fighting. Call the assholes assholes instead of ‘people of slightly different opinion.’

I think Kirk makes some good points here. It’s easier if you’re a SWM of which Kirk and myself are to shrug it off. We’re not the ones that hate peddlers go after. No one is blaming us for terrorism, calling us sluts, or saying we’re deviant sinners who are going to hell because of who we love. I don’t know honestly what the solution is but the fact of the matter is that it is deeply troubling that we have a culture of hate radio where guys like Limbaugh, Hannity, Beck, etc incite hatred and what’s even worse is the politicians that enable them. You never ever hear about Republican politicians denouncing Limbaugh’s words. You do see them cower to him when they “step out of bounds” though and frankly that’s wrong.

Data gathering is a good first step. If this really is functioning as stochastic terrorism, then there should be the data out there to make that case.

Seems to me after reading some more on it that this is merely rehasing something that was done in ‘93. Makes sense given that media has changed a lot between ‘93 and the present.
