Understood. I have simply always argued that I believe they are not soldiers, not combatants but criminals no different than mafiosa or columbian drug lords. As a result they should be treated the same.

WHY do they deserve to be treated like honorable soldiers when 99.99% of them will not act like soldiers? No, they are simply criminals to be dealt with, and disposed of, accordingly. To do otherwise grants them more respect than they deserve.

Hence their designation as “unlawful combatants”. It is also needed for cases where we capture someone who is fighting us, but who cannot be linked to an act of terrorism. To set that person free would simply allow him to resume the fight, but he may not be eligible for a trial. For such foreign nationals, detention is the best policy.
