It’s rare, but it still happens on occasion; certainly cases are cited which cite English common law. However, international law is cited sometimes in agreements with American Indian tribes.

A lawyer friend of mine said the more serious problem is actually that, constitutionally, treaties are the law of the land, and this law forbids judges from considering treaties in some circumstances; that is unconstitutional.
