No, it wouldn’t. It would mean that a President who is forced to fight a war would be reluctant to leave office, for fear of war crimes charges. No former president could travel to Europe, since there will always be someone there who files charges.
No matter how cleanly we fight, a nation fighting a war will always end up killing innocents and doing some ugly things. War crimes trials would ensure we could never fight again without very ugly recriminations.
Bush already can’t go to Europe. And I don’t feel sorry for him.
