Well, he’s falsely identifying her as a woman who lied about being raped, and continues to do so even after he’s been shown to be mistaken. That means he’s doing it deliberately at this point, so there’s malice involved.

I ain’t no lawyer but I think she’s a got more of a case than any of the threats Chuck has made.
