If the government - as opposed to BP - determines who gets the money then it is a takeover of 20 billion. You may argue that’s a good idea but it is a takeover. If it’s just an escrow account that BP (or the courts if suit is filed) has full control over when it comes to paying out the cash, then I’m not too concerned about that.

It is an escrow account, to be administered by a third party. It would be insane to give BP control over that account.
