Read that wrong. I suppose you did, but there is the issue of determining the loser before trial, which is of course impossible.

I never stated that determination could nor should be made. What I did say is that knowing that even if the small company “wins”, they will still be out of pocket for (possibly) years before they can re-sue for the expense of the 1st trial

IF that 1st trial ended up with an auto ‘loser pays” the small business wouldn’t have to worry about it
