Also, random though, but one of the reasons this is an unusual situation is because Supreme Court Justices tend to not resign during presidential elections. It’s not uncommon for Justices to wait until after an election, usually in the hopes that whoever wins will appoint a like minded successor.

That said, I still think Obama should nominate someone to fill the seat and that the Senate should vote on that nominee.

Scalia most likely died in office because he was not going to retire while a Democrat was president.

For the Republicans to burble on about letting the next president make the nomination is especially obnoxious in this context.
