Obama’s words, however, sound a bit empty. If w/b is torture, then act on it. Investigate. Prosecute.

Not going to happen. Obama has deliberately refrained from attempting to bring charges against anyone in the Bush Administration. IMO, he has done this to ensure that the American tradition of a peaceful transition of power is not endangered. If officials feared they might be prosecuted by an incoming administration whose legal views differed greatly from the one in which they served, they might be inclined to try some sort of 3rd World-style power play. Barack Obama is far-sighted enough on this matter to understand that the need to make sure a change of parties holding the White House remains peaceful outweighs the benefits of prosecuting a few people you think were malefactors.
