I’m pretty convinced that, if the Dems manage to retake the Senate Nov 8th, come Nov 9th the GOP will suddenly be amenable to scheduling a confirmation hearing and vote for Garland. The smartest thing the President could do in that instance is immediately rescind the nomination and say “The GOP is right, the voters should have a say, so I’ll leave the nomination of Justice Scalia’s replacement to the new administration.”
