The issue of consent is complicated by the inequality of most familial relationships. And most people aren’t going to ask for a DNA test if somebody makes a claim for an exception to an abortion-denial on the basis of rape, to determine whether is WAS incest, with somebody wanting to conceal evidence.

You’re also left with problems like Iceland, where they have an app for cellphones (of course) to determine consanguinity due to the low population and relative isolation of the country.

“Lemme check my phone and see if we should marry - oops, we’re first cousins.”

Laws in the USA which prohibit an adopted child from knowing who their biological relatives actually promote unintentional incest.

Also, millionaires can jury rig the law to protect their fortunes, as in this case:
