Yeah, I’m sure I’ll get a coherent list of Cliven’s rights that have been violated.

When you get your news from Fox News, what do you expect? They can’t even get the basic facts right.

And the legal claims by him and his supporters don’t hold up to scrutiny. Heck, he’s hardly the first to make these claims, and the courts have swatted them down before, most recently in US v. Gardener, where the facts and circumstances were similar, and the court found that the defendant didn’t make the case that they were entitled to the land namely because the land in Nevada was never Nevada’s - after winning it in war, it was federal land before it joined the Union as a state: “the US has held title to the unappropriated public lands in Nevada since Mexico ceded the land to the United States in 1848”. That distinguishes it from Pollard’s Lessee, which found that the land was previously the state’s. Nevada never held title to the land in question. It was first Mexico’s, then the federal government’s.

Facts and circumstances. How do they work?
