Rand’s beliefs here are an extension of his Dad’s. Ron Paul has maintained, and I suspect this is where the likes of Bachmann pick up this idea, that Congress can circumvent the USSC. It’s all part of the wingnut True-founding-fathers dogma, that has also precipitated the TYRANTS IN BLACK ROBES!! outrage.

It’s known as the “No Such Thing As Judicial Review” argument, that says SCOTUS can’t overturn laws written by Congress, only deem them constitutional or not, that it’s the job of Congress to address those laws deemed unconstitutional.
