No I think it was done as a rhetorical question with in her speech. Kind of like when you come home late and you tell the wife “should I just have taken the ditch to get around the traffic then?”

Obviously something happened, a decision was made to change venue and plea, and place KSM in civilian court. That decision could only come from the defendant and the White House/Attorney General.

With that in mind it could be sated that both sides just happened to do each at the same time, after all anything is possible, however it is unlikely.
