The medical examiner can rule whatever he wants to, but until Congress explicitly nullifies the year and a day rule established in Jewell v. Territory there probably can’t be a federal prosecution.
The Supremes did however rule in the 2001 Rogers v Tennessee case that a state could repeal the year and a day rule and apply that change retroactively.
Looks like someone (med examiner) is reaching.

Killer is a mental patient. Jim was 73, well into the years where a medical expert for the defense could raise doubt about that conclusion that the bullet rather than natural ageing killed him 33 years later.
