The appraiser should have seen the different names on the deeds (and read the metes and bounds on each). So, s/he should re-do it and not charge anything. If you don’t have a closing lawyer, get one. S/he can advise you best on what to do. The buyer can’t get title insurance anyway as it stands. And the buyer now has an excuse to bow out of the contract if s/he wants. Both the RE agent and appraiser should have known better.
Well the lawyer looking to resolve this problem is the buyers lawyer. They are not going to pull out of the contract. They have spent too much money and really want the house. I have a feeling the attorney will be able to find a solution but I’m still going to lose a few more pounds this weekend.
