John Marshall was appointed by a lame duck. I have no problem with keeping Garland’s name even if the Democrats win back the Senate and presidency. Clinton or Bernie will be able to pick their own. Now if Obama wants to withdraw the pick as a sort of fuck you to the GOP for obstructing and replace him with a more liberal one, I’m okay with that too because the GOP has acted like children over this but I don’t think Obama will do that. I think Obama respects the court too much to do that. Besides it’s not the end of the world to me if Garland is a centrist.
