I don’t know if I’d go that far. Sometimes people decide to play the lottery with the court system in the hope that their adversary would rather settle than let all the details come out in court, even if their own skeletons in the closet are no less vile. Software patent trolls do this all the time; they file lawsuits against companies who infringe in the hope of obtaining a settlement and license agreement, gambling that their opponent won’t press the issue and get the patents invalidated.
