It’s a constitutional issue only in the sense that constitutionally derived law will not permit the authorities to discriminate against the property owner based on race, religion, etc, etc.

For example, taking this out of Manhattan, the zoning board in Berkeley could have decided not to let Congregation Beth El build their big new shul in the hills if they had determined that the plan to have loudspeakers blasting ‘Hava Nagila’ out over the neighborhood until midnight every evening was not OK. What they then couldn’t do is allow a church to do the same thing and blast “We Plow the Fields And Scatter”.

Interesting. May I assume that the same would apply even if it was not a shul but a community centre?
