The main reason being that he targeted a specific person, Sandra Fluke. Had he bloviated about women in general then it would be considered a freedom of speech issue. Of course that would also apply with specifically targeting Sarah Palin as well. Other considerations are if a person qualifies as a public figure. IMO Sandra Fluke having only been a congressional witness does not qualify as a public figure. Just some thoughts.

I thought it was a freedom of speech issue only if the government is impinging on someone’s speech.
