You just have to go the extra mile to take his position. In this case, the extra mile Rand Paul goes to insist property rights trump the 14th amendment means something.
What changed in the 60’s wasn’t so much about property rights, but a sea change in public opinion (and law) about the meaning of “open to the public” —for businesses (Woolworth’s lunch counter), public facilities (buses, pools, parks, etc) and other institutions (schools, universities, etc).
