I wouldn’t waste any time worrying about it.
It would be political suicide for whoever was that petty, especially I when there will likely be some real reasons to question a nominee’s fitness in many peoples’ minds.

This seems to be the season for political suicide, and I would be shocked, albeit pleasantly, if a gay SCOTUS nominee’s sexuality was not, albeit under cover used against him or her, and the administration that had the gall to suggest him or her.

(Her, I presume, we’re talking about Kagan, right?)
