You miss the point. The whole idea of letting states have a share of the power is letting states have a share of the power. Questions such as who gets visitation rights are like questions of what the rules on marriage are. Different states have different laws.

Does anyone here know what Texas law is right now? Do married couples from other states have hospital visitation rights, currently, if they’re same sex? I don’t know. At a guess, the answer would be yes.
