Exactly. The argument that I’m seeing Scalia make and I’ve seen it from Alito in the past is that gay marriage is “new” so ergo it shouldn’t be valid. What on earth kind of legal logic is that? And the whole idea that “Well most states have it, so the prejudices will die out” thing that I think Roberts has pushed is stupid too. Most states had gotten rid of their bans on itnerracial marriage pre-Loving but didn’t make Virginia’s ban on same sex marriage any less unconstitutional. Our supposed “constitutional conservative” judges are intellectually dishonest hacks.
