MARIETTA - A Marietta police officer terminated nearly two years ago upon accusations he had sexual relations while on duty is returning to work on Monday.

Joe Hilverding, terminated in June 2009, admitted the affair, but denied it took place while he was working. Other Marietta police and fire employees also admitted to on-duty sexual encounters with the same woman who accused Hilverding.

When he returns to work Monday, Hilverding will receive gross back pay of $36,456, plus an additional $12,000. The arbitrator ordered the city pay $1,000 a month between June 2009 and June 2010.

In addition to that money, Dauber said the city would also pay $1,307 into workers’ compensation, $718 into Medicaid, $7,322 into retirement and $1,093 into a longevity account for Hilverding.

“The city also paid around $9,000 unemployment following his termination,” Dauber said.

Legal fees amounted to about $50,000 for the city.
