Sovereign immunity has, thankfully, been routinely eroded over the past few decades. Try to apply a dying doctrine to a case based on an express provision of the constitution, seems… foolish.

I’d have gone with either challenging plaintiffs’ standing, or with the political thicket argument, but, you know, to each his own.

Aren’t those in DC filing because the president owning the hotel hurting their profits, which means they would have standing?
