Essentially he could have made the same argument with slavery. Would like to see him try that. In consideration of all of the recent neo-Confederates though there’s no doubt that he, they, are thinking about it. If it was up to them they would have said something akin to “congress had no Constitutional right to outlaw slavery and the outlawing of slavery should have been left to the sates.”
