A question might be: Were Beck’s words malicious or could a lawyer argue they simply resulted from an excess of zeal in the nation’s defense?

All arguments are possible. However, any lawyer that would want to bring that argument to a properly selected jury (i.e., a jury haven no more than its fair share of wingnuts) would need to have his/her head examined.
