The Rick Perry Brain Freeze Syndrome strikes again in an interview with the Des Moines Register, as he forgets the name of Supreme Court Justice Sonia Sotomayor, then attacks the “8 unelected judges” on the Supreme Court, which has 9 judges.

Stunning.

Even though you know he's an idiot. Even though you know that he doesn't have a clue as to what he's talking about. Even though you know that he's only memorized what he's supposed to say to garner votes, and isn't actually saying what he believes (which is why he makes such obvious gaffes when he forgets what he's memorized), it's still stunning to see how vacuous are these Republican Party candidates. Not that Gingrich is any less odious as a candidate, but at least he can articulate an argument.

OT:

Seems VA State Police finally identified the shooter in yesterday's tragedy at VA Tech. Ready for a new twist?

Virginia Tech shooter named

BLACKSBURG, VA --
State Police named the suspect in the Virginia Tech shootings as 22-year-old Ross Truett Ashley, of Partlow.

Virginia State Police have identified a Spotsylvania County man as the subject responsible for the murder-suicide that occurred Thursday (Dec. 8, 2011) on the Virginia Tech campus. Investigators have confirmed that Ross Truett Ashley, 22, of Partlow, Va., took his own life approximately a half-hour after fatally shooting a Virginia Tech Police Officer. Ashley also had a local residence in the 1000 block of East Main Street in Radford, Va.

At this time, there remains no prior connection or contact between Ashley, who was enrolled part-time at Radford University, and the Virginia Tech Officer he killed. State police investigators are continuing their work to establish a motive in the killing and to recreate Ashley’s movements in the days and hours leading up to the murder-suicide.

Ashley has been identified by Radford City Police as the individual responsible for the theft of a white 2011 Mercedes SUV from a real estate office in the City of Radford on Dec. 7, 2011. The Mercedes was stolen at gunpoint at approximately 11:25 a.m. Wednesday from Gilbert Real Estate in the 600 block of Calhoun Street. A male entered the business armed with a handgun and demanded the keys to an employee’s vehicle. No one in the real estate office was injured. The subject got away in the SUV, which was located the next day (Dec. 8) on the Smart Road at Virginia Tech. At the time of the armed robbery, Radford City Police had issued a multi-state “Be On the Lookout” (BOL) for the stolen vehicle. When Blacksburg Police responded to a call of an abandoned vehicle on the Smart Road on Dec. 8, they immediately notified Radford City Police of its recovery.

Seriously, I wonder how the people in Texas view their governor when he makes all these really idiotic mistakes. Now, people speaking publicly often misspeak, and during an exhausting job like campaigning I'm sure tiredness sets in. re: #51 Charles

Not really. A Greenpeace led attempt to protest in the halls outside the rooms in which the informal meeting (but really where all the action apparently happens) led by the President of the COP17 (South Africa) was being held. He and about 40 others were kicked out... all without the use of pepper spray (heh).

A couple of minutes ago the COP17 President released the latest working text of proposed changes to the Kyoto Protocol and other actions that could be done:
[Link: unfccc.int...]

While the US didn't ratify the KP, the above has become what I'd call the diplo-hot-potato. That is, so many nations have their diplomatic face wrapped up in continuing the KP that any attempt to not continue it is not possible by the COP as it would then appear they would have failed.

All of this is necessary because the commitments by the nations under the KP expire at the end of 2012, and at least three nations (Russia, Canada, Japan) now using KP have said they won't submit to a second commitment period.

So now it has all become a face-saving measure to make sure there is a continuation of the KP, all the while everyone understands it is actually an insufficient instrument to address climate change.

This then sucks all the wind out of efforts by various nations to create a new legal instrument that would hopefully bring in the US. But as my link earlier explains, that was derailed by China as the only possible way the US would sign up to an agreement is if China was treated equivalently (i.e., required to limit its emissions), and by default any new agreement would (in practice) supersede the KP over time.

So they've all wrapped themselves into a giant gordian knot, where the US (along with some others) won't go ahead with the KP, while others won't go ahead without the KP.

Second Major Labor Group Condemns Occupy Movement’s Planned West Coast “Solidarity” Port Shutdown

While the Council notes that it supports many of the claimed goals of the Occupy movement, “the call to shut down operations at the Port of Oakland, where many of our unemployed workers and newly-indentured apprentices have recently been able to get back to work, makes no sense.” Jeff Smith, president of ILWU Local 8 in Portland, told the Portland Tribune that his members will not honor the Occupiers’ picket lines: “This is a third-party strike. We have to go to work.”

There has been some internal dissent within the ranks of the Occupy movement, but the realization that they will be actively fighting against the very people they claim to support does not yet appear to be widespread.

There’s one last possibility (let’s say an American “hope”): the drone is real but it was deliberately sent and made crash in Iran as a sort of trojan horse, carrying malware or other Stuxnet-like viruses. A bit far fetched but intriguing.

re: #87 Obdicut

Take the following with a grain of salt:

The most frightening prospect raised by what appears to be a largely intact Sentinel is that the Iranians’ second claim about how they brought it down ― by hacking into its controls and landing it themselves ― might be true, said a US intelligence official, who spoke only on the basis of anonymity because the RQ-170 is part of a Secret Compartmented Intelligence (SCI) program, a classification higher than Top Secret.

Hacking Claim

The official said the possibility that the Iranians or someone else hacked into the drone’s satellite communications is doubly alarming because it would mean that Iranian or other cyber-warfare officers were able to disable the Sentinel’s automatic self-destruct, holding pattern and return-to-base mechanisms.

Scotusblog:
Texas election maps blocked, for now

The Supreme Court, working late on a Friday, agreed to rule on the constitutionality of three redistricting plans for the two houses of the Texas legislature and its 36-member U.S. House of Representatives delegation, and put on hold temporarily a U.S. District Court’s interim maps. The Court ordered expedited briefing, and set a hearing on the cases for Jan. 9 at 1 p.m. The Justices’ action gave Texas much of what its lawyers had sought in their challenge to the three-judge trial court’s temporary maps, which were to be used for the 2012 election cycle. The Court’s order is here. It raises the strong possibility of a major new ruling on the power of federal judges to draw up redistricting plans while a state legislature’s own maps are under challenge in court.

Labour unions oppose Occupy protests at B.C. port facilities Monday

Unions and labour organizations, like the British Columbia Federation of Labour, which represents about 50 affiliated unions and 550,000 members, say that while they may support the Occupy movement's greater objectives, they don't support the port protests.

"The BC Federation of Labour does not support this action, or any action by the Occupy Vancouver group at Vancouver area ports that seeks to prevent our members from carrying out their assigned duties and working safely," the federation said in a news release.

Scotusblog:

From a quick look over in Wikipedia on apportionment and the Constitution I don't see anything preventing Congress from taking away the mapping process from the state legislatures and imposing a set of standards that could essentially end gerrymandering. And I think there are SC decisions and Congressional apportionment standards already in place indicating their ability to impose controls.

Not to mention the House's stated power "Each House shall be the Judge of the Elections, Returns and Qualifications of its own Members, and a Majority of each shall constitute a Quorum to do Business," in Section 5 which is a pretty solid basis for Congress having ultimate control of how it's membership is elected.

Romney Admits All His Income Comes From Investments, Which Helps Him Pay A Low Tax Rate

Romney won’t release his tax returns, so it’s impossible to tell with complete precision what his tax rate actually is. However, during an interview today with the editorial board of the Des Moines Register, Romney said that all of his income is from interest, dividends and capital gains, meaning that the CTJ analysis of his tax plan likely has a lot of truth to it, if it doesn’t overestimate how much he paid:

My own calculation is, if that were the case, for anybody, no taxes on interest, dividends, and capital gains, I would have paid no taxes in the last ten years, because all my income is from dividends, interest, and capital gains.

I like this theory...

I like that too, as a fantasy. I cannot believe that the US would not have a self destruct in these things for a worst case scenario. It is not so much Iran that worries me. It is giving this to China, Russia and N Korea, and anyone else who will pay.

As commented elsewhere, it looks like the wings may have broken off and been reattached, and the bottom is covered because it is damaged.

These flying wings are not inherently stable without active controls so I imagine it may have lost power and belly flopped into the ground at fairly low speed, and I see that Iran suggests they may have compromised the remote control electronically, perhaps with Chinese help if true?

Whatever the truth I think someone should lose their job for letting this happen.
