Prosecutor: George Zimmerman Will Be Charged

Citing a “law enforcement official close to the investigation,” the Washington Post reports that the special prosecutor in the Trayvon Martin shooting case is going to charge George Zimmerman with a crime.

They’re not saying exactly which charges will be filed, yet. A news conference is scheduled at 6 pm ET.

Charging him is one thing. Finding him is a whole 'nother. I have suspected for weeks that he's long gone out of the country. No one has reportedly seen him since this whole thing went down. Even his lawyers had never met him face to face, if I recall correctly. Only talked to him on the phone. If we ever see an actual trial, I will be surprised.

I am regularly thankful that I live in a country in which there are so many checks and balances on the power and operation of governmental (and private) organizations. Very very many things need to go wrong at once in order for a situation to be irrevocably screwed up. Even in this impressively botched grabasstic clown-show, the killer of Trayvon Martin looks (eventually) likely to be tried in a court of law for his actions.

Gives me hope, sometimes.

It clearly can't be murder 1, because that would have required a grand jury to be empaneled.

That leaves murder 2, 3, or manslaughter. My bet is on manslaughter, though it could be murder 2 and murder 3 depending on the evidence the prosecutor was able to review.

It's going to be a tough prosecution with the local cops botching their job early on. Also some key witnesses have made public statements and shown bias, which makes them easier to challenge on the stand.

I doubt if many will be happy with a plea bargain that doesn't include significant jail time.

His lawyers also intimated that Zimmerman was no longer in Florida, which raises issues of a manhunt/extradition. That conference yesterday was also a lesson of how not to dismiss your client. Could be seen as highly prejudicial against the client's interest (saying that he's not listening to advice, wont listen, and is doing his own thing).

Unless it can be shown that Zimmerman was breaking the law up until the critical point, it's hard to see how the SYG would not apply. It doesn't actually matter what the law was intended to accomplish. As long as it is badly written, it may still fuck things up.

I don't think he will be hiding from the law. The only real stumbling block would be if he was incapacitated - by himself or others. There is a possibility that he will be hiding, but that would be dumber than anything before this, taken together. I expect him to show up.

Considering that there was talk their media campaign of stating speculation about the case as "fact" was straddling, if not over the ethical line, nothing about the way they acted yesterday surprises me.

First he'll have to surrender to authorities, obtain new counsel, and once we know what the charges are, we might get an idea of whether a plea deal could be worked out or whether this goes on through to trial.

Lawhawk can fact check me on this, but I don't believe they can be charged with obstruction if they refuse to answer the question (where is he?) and tell the cops to talk to their Lawyer. They could only be charge if they answer the question with a lie (we don't know) that was later proven after the act.

I knew he contacted Hannity without his lawyers knowing about it, and I think his website went up without their knowledge too, but he also tried to contact the prosecutor? Wow. I didn't know that.

I would think that any one of those things would be grounds for a lawyer to fire their client, but all three? No wonder they quit in such a fail-tastic way.

Apparently they got word from the special prosecutor's office that he'd tried to contact them without counsel present, referring to them as his "legal advisers." The office responded back that they couldn't talk to him without legal representation present.

I'm not sure whether to consider the man arrogant or cracked.

I don't foresee riots if he's acquitted, though the NBP will probably try to fan the flames, but seeing as they don't have a big following outside of the white nationalists, very little will happen. Maybe protests, but no violence.

If Zimmerman is found guilty, yeah, I do see shit hitting the fan, thanks to the neo-Nazis and other racists try to instigate a race war, but I hope that I'm very, very wrong on this.

Either way, regardless of the trial, someone will be very pissed at the outcome.

SYG has already been used as a successful defense for exactly that:

A judge has dismissed a murder charge against a man who chased and fatally stabbed a suspected thief, citing the same self-defense law at the center of the Trayvon Martin case.

The "stand your ground" law gives a lot of leeway to use deadly force instead of retreating during a confrontation.

Miami-Dade Circuit Judge Beth Bloom ruled Tuesday that a bag of stolen car radios Pedro Roteta swung at Greyston Garcia amounted to a lethal threat. Bloom said Garcia "was well within his rights to pursue the victim and demand the return of his property."

Garcia went home instead of calling 911 after the confrontation in January and later hid the knife and sold two of the radios.

I'm in the middle of reading Destined to Witness: Growing up Black in Nazi Germany. I've been struck by a couple of things. One is the lack of Aryan characteristics in the leaders. Two is that the author quotes from Mein Kampf and it sounds exactly like these white supremacist assholes. Scary stuff.

I have a couple of questions that I hope any of you can answer.

Does anyone know for sure if the New Black Panther Party actually put a bounty on GZ's head with wanted dead or alive posters? I've look and all I find are rightwing blogs and I don't trust them.

Also, does anyone know if the ABC video where they magnified GZ's head to show "scars" on the top of his had-has that video been discredited? Again, cannot find much and no one is talking about that clip.

It's all very strange to me. I've never seen a lawyer act like that in a high profile case such as this. Have you?

What would possess them to come out TODAY, coincidentally the very day they are going to allegedly charge him, and say, very specifically, we haven't seen nor heard from him since Sunday.

These are the lawyers who said they have been in close contact with him and know where he's been ever since the story got really hot. Wasn't it the same lawyers (or was it his friends) who said he's shocked and amazed that all this hubbub is swirling around him and he had no idea about it, like a week after it hit the papers. When you couldn't turn on the TV or look at a paper without seeing Zimmerman's face all over, and he knew nothing about it? Bullshit.

Something about this smells real bad to me. Unless it's purely coincidental.

Hence why I shook my head downstairs at the notion that filing charges when there's little chance that they'll stick would be a good call on the part of the special prosecutor. Just the act of bringing charges is stirring things up, as would the act of closing the case with no charges.

No, I foresee this thing ending up like a lot of cases in the last 20+ years have, leading to a trial and verdict that leaves one side or the other angry.

It doesn't say it's not OK either. Only clearly illegal actions prior to the confrontation are defined as obviating the defense. The law covers anyone who otherwise has a legal right to be where they are, and that's Zimmerman. The fact that it doesn't affirmatively deny the defense in cases of legal pursuit is an inherent flaw in the law, not in the reasoning of the judges and prosecutors who so far have comprehend its clear and unambiguous language.

I really don't get why you're sticking to this. As GDF discusses in his reply, ([Link: littlegreenfootballs.com...] there is an obvious counterargument. It seems like you're just deliberately avoiding the way that SYG could clearly be used to let Zimmerman go.

In fact, the police chief said, explicitly, that SYG was the reason Zimmerman want' charged. Whether that will stand up in a trial remains to be seen, but clearly the reality is that the law is, in the real world, conceived in such a way as to allow for pursuit on the part of the person claiming "self-defense." I'm sorry, but I just do not believe that Zimmerman can be convicted of anything given the current laws in Florida. As long as he sticks to his original story and it also cannot be positively disproved by new evidence there is no chance of successful prosecution that will survive appeals.

If the prosecution has nothing beyond what we already know for definitive evidence then attempting to prosecute him will be nothing more than a political exercise in appeasement, one that will be ultimately futile.

I know! I was a little young for Twilight Zone. It was a bit beyond me. I never missed the Outer Limits. It was also cheesier and more cheaply done. I didn't appreciate that "camp value" until I got much older.

Florida has a very strict set of mandatory sentences for crimes involving guns. Ironically, they were passed as anti-gangbanger 'get tough' legislation.

My Law & Order experience tells me that either the special prosecutor has enough evidence to go straight for 2nd degree murder without going for a plea bargain (seems kind of risky, not knowing what they know) or they're going for the max charge they can put in front of a jury and hope that they can either drag enough evidence/witnesses out to support the charge or to get Zimmerman to cop to murder 3 or manslaughter (much more likely).
