I just read the whole 6th Circuit decision and dissent and all I can say is, I don’t think her fellow judges on the panel will be inviting Martha Craig Daughtrey (the dissenting judge) to lunch anytime soon.
(I know there are a few pages about this ruling, but I thought I’d offer some of the highlights of the dissent for your overnight reading enjoyment.)
She painted them as the buffoons they are, showing no mercy.
From her opening
The author of the majority opinion has drafted what would make an engrossing TED Talk or, possibly, an introductory lecture in Political Philosophy. But as an appellate court decision, it wholly fails to grapple with the relevant constitutional question in this appeal…
to
my colleagues view the plaintiffs as social activists who have somehow stumbled into federal court, inadvisably, when they should be out campaigning to win “the hearts and minds” of
Michigan, Ohio, Kentucky, and Tennessee voters to their cause.
to
The majority’s “original meaning” analysis strings together a number of case citations but can tell us little about the Fourteenth Amendment, except to assure us that “the people who adopted the Fourteenth Amendment [never] understood it to require the States to change the definition of marriage.” The quick answer is that they undoubtedly did not understand that it would also require school desegregation in 1955 or the end of miscegenation laws across the country, beginning in California in 1948 and culminating in the Loving decision in 1967.
to
The principal thrust of the majority’s rational-basis analysis is basically a reiteration of the same tired argument that the proponents of same-sex-marriage bans have raised in litigation
across the country…As previously noted, however, this argument is one that an eminent jurist has described as being “so full of holes that it cannot be taken seriously.”
to her closing comment
If we in the judiciary do not have the authority, and indeed the responsibility, to right fundamental wrongs left excused by a majority of the electorate, our whole intricate, constitutional system of checks and balances, as well as the oaths to which we swore, prove to be nothing but shams.
BOOM.

re: #1 BeachDem
Today, my colleagues seem to have fallen prey to the misguided notion that the intent of the framers of the United States Constitution can be effectuated only by cleaving to the legislative will and ignoring and demonizing an independent judiciary. Of course, the framers presciently recognized that two of the three co-equal branches of government were representative in nature and necessarily would be guided by self-interest and the pull of popular opinion. To restrain those natural, human impulses, the framers crafted Article III to ensure that rights, liberties, and duties need not be held hostage by popular whims.
Mic drop.

Those familiar with the LGF history probably know Trifkovic. A now former lizard Kejda Gjermani wrote this expose: kejda.net , which was advertised here.
Oh, a charming fellow, he. Just the kind of people the separatists would want in Luhansk and Donyetsk.
I’d bet that Abernathy fellow is another Robert Spencer associate, but I haven’t exercised my google-fu to its highest level today.
BTW, I asked my Ukrainian neighbors about who they favor. Both said they are trying to remain neutral; they’re musicians not politicians, they said. Mostly they worry about their families, about the lack of municipal utilities and food. I sensed they both would prefer to be governed by Ukraine and not by Putin surrogates, and would just as soon the pro-Russian, extreme right wing factions get the hell out of Luhansk.
I also gather both have family members who are pro-separatist, which may explain why they are trying to remain neutral.

Frank Abernathy, a Nashville lawyer, is a nephew of Dr. Ralph Abernathy, the civil rights leader. He might be the only reasonably sane person in that contingent.
But I wonder whether he knows what kind of people he’s working with there. His uncle Ralph could have smelled them a mile away for the bigots and right-wingers that they are.
Frank Abernathy has this quote in Russia Today:
𠇏irst I believe the elections followed international standards of democratic elections. I was very impressed with the enthusiasm and the vigor with which the people went to the polls to express their opinion,” US Senior Attorney Frank Abernathy, an observer in Lugansk, told RT.
Mr Abernathy is a tad naive, I believe.

Just this morning some wingnut was derping at me that those aren’t the “real” unemployment stats, and he linked some libertarian shitistics that unemployment is closer to 12% or 86% or eleventy gazillion %.
So I asked him “What the GOP jobs plan, other than union busting & no more minimum wage” And he’s like HURR HURR DON’T CHANGE THE SUBJECT!!!!!!!

Sorry, Dr., but the problem isn’t the fact of whether or not it’s happening, but the likelihood of us doing anything about it. And the election is going to ensure that politically Climate Change is going to be treated like the worst hoax in the history of ever, especially with Inhofe in charge of the committee.
I hope you’re ready for indictments on the frivolous charge of treason alongside Prof. Mann, Dr. Because it’s probably coming soon.

Well, it’s true the Dems did hand out free gas cards in 2008 and 2012 and that’s why Obama won.

Right. Inholfe in charge of the environment committee. I think McConnell showed what the GOP is all about in a nutshell with that placement. Anyone who believes that since they got the majority in the Senate, the Republicans are going to be reasonable is nuts, in fact I think this will embolden them.

I agree…. I know where NDG is going with that… but the problem is that the denial of the science and refusal to act is now going to be even more deeply embedded into the Congress. I’m going to hate to see who the GOP puts on the various Science committees.
I have no doubt it will be a “blue ribbon” group of experts ///

Lord Monckton, I totally expect will be there and will be treated with more respect and deference on the issue than any scientist ever has. Because a British pseudo lord knows more about climate science than someone who has actually spent their life studying it.
