Nope. Totally fucking believable. This is how the Bannon/Trump admin will play out. They’ll bluster with BS and try to bully their way through the courts, but the courts are a bulwark against executive overreach and defend against unconstitutional acts. That’s their job. And by and large, they do it. Sometimes it’s in fits and starts. But the trajectory of progress is mostly forward.

The GOP hates this, which is why their ability to nominate radical right wing extremists to the bench will disrupt the progress. That’s why elections matter. That’s why winning the WH matters. It’s why midterms matter - and all the elections in between. /choir-preaching

Bannon/Trump will be unhinged when this decision is released. On that I have no doubt. It’s all they do. They will do nothing but claim that this court reduces Americans’ security, even though they can’t point to any actual threats that could have been prevented with this action in the past, and they specifically excluded countries that are known risks (and ones whose citizens did carry out attacks).

It violates due process, failed to be implemented consistently, and was done with malice aforethought. That was all done on purpose.

Got up early, went in and had an umbilical hernia repaired this morning. Ive been sleeping off the anesthesia at home and while sleeping the pain meds wore off. That made for a painful trip to the john. Oh well, popped 2 vicodin and awaiting for them to kick im while reading here about the nations schools saying ow since their enemy landed behind the lines today.

Also, when the judge says “I’m a little confused on if you’re relying on these cases as precedent or not.” you’re probably doing something wrong.

Listening to the 9th District Appeals court arguments here are rather fascinating - The Washington State Attorney has been providing citations of precedent, as well as other case law supporting why the travel ban should be blocked.

On the other hand, Orange Julius Caesar’s Justice Department attorney’s entire argument has hinged on “He’s the President and he is allowed to issue these edicts and dissent is not allowed.”

Judge Clifton asking if there’s any authority for the counsel of the president telling departments and courts what the EO means. And why doesn’t the president amend the EO? DOJ lawyer saying White House counsel speaks for the president. A strict constructionist isn’t going to appreciate an argument beyond the four corners of the document like that.

Hatch is best known for playing Apollo on the original Battlestar Galactica, and had a brief but memorable role on the new BSG.

Flentje has worked for the Justice Department’s civil division for most of his 19-year career there. Kneedler, who has been with the solicitor general’s office since 1979 and served as deputy there for the past 24 years, has argued more than 100 cases before the U.S. Supreme Court.

Richard Hatch passed away at age 71. He died of pancreatic cancer; he had moved into hospice a few weeks ago.

Hatch is best known for playing Apollo on the original Battlestar Galactica, and had a brief but memorable role on the new BSG.

Holy Crap! I just saw him at a small Comic Con here in Colorado last August. Stopped and had a nice chat and go a picture of him with the R2 astromech droid.

OpSec News from Ars Technica: Scoping out the Wi-Fis with WarCollar’s DopeScope and Booby Trap

The company got its name from a device Bransfield built as part of a project he presented at a DefCon 22 talk entitled “Weaponizing your Pets: The WarKitteh and the Denial of Service Dog.”

Bransfield recounted:

I took a microcontroller, GPS, Wi-Fi, Battery, and storage and got it down to a form factor that would fit on a cat collar. I sent the cat wandering around Washington DC doing Wi-Fi Scanning for me. The product worked, the talk was very successful and soon people were asking me to make these things—so I created WarCollar Industries.
Bransfield’s side-line hardware operation soon became a security consulting company as well before the company he worked for was acquired by another, much larger company.

Bransfield and WarCollar have collaborated on another hardware project: an Internet of Things corset configured with captive portal access points. The “Booby Trap”, designed and worn by security researcher Nicole ‘AmazonV’ Schwartz, was equipped with malicious access points broadcasting common access point names (such as “attwifi”, “xfinitywifi”, “NETGEAR” and “LINKSYS”). The low-power access points would connect with smart phones whose Wi-Fi was turned on once they got into range. It displayed a “captive portal” web page on the victim devices announcing, “You’ve been caught in my Booby Trap.”

How effective? Very….

The current incarnation of the [Booby Trap] software advertises multiple WiFi SSID’s and allows anyone to connect. Once a victim connects to the access point (AP), their MAC and the SSID they connected to is recorded, and they are re-directed to a fixed landing page. The landing page is a mild reminder that allowing your WiFi enabled devices to connect automatically to an AP may be a bad idea. When captured victims attempted to browse the web, they were presented with a picture of AmazonV in her corset stating “You’ve Been Caught in my Booby Trap.” While this solution itself is relatively harmless with some minor modifications to the code, it is possible to intercept the web traffic, track user activity and even fool someone into providing their user credentials.

The point—one we’ve made before in Ars Tech Lab with our own demonstration—is that leaving a mobile device’s Wi-Fi turned on can be a big security risk. In 2015, researchers at Wandera demonstrated that this sort of Wi-Fi captive portal could be used to spoof Apple Pay screens and potentially steal credit card data. But even at security conferences largely populated by the paranoid, devices were easy victims for the Booby Trap. At DefCon in Las Vegas last August, the Booby Trap “caught” 1432 devices and identifoed 1238 unique hardware (MAC) addresses. At this year’s Shmoocon, with a much smaller attendance (about 2,000 versus the over 20,000 at DefCon), 167 devices were “caught”, with 156 unique MAC address.

I am already on the no blood and organ donation list thanks to the BSE problem in Europe when I was stationed in Spain.

This is one of the reasons when liberals propose that organ donations should be “opt-out” that I am opposed to that suggestion. There are millions of people in the category of “may not donate” that do not realise they are.

(Of note, FDA regulations prohibit blood donations from people who lived in Europe for certain periods. Abolishing the FDA or regulations would allow persons with vCJD to donate blood or organs. vCJD cannot be detected by a test, only by an autopsy.)

Moments ago, Senate Republicans ruled that any Democrat who criticizes Jeff Sessions’ record will be stripped of the right to speak as we discuss his potential confirmation to be Attorney General.

It all happened when Elizabeth Warren was reading a letter written by Coretta Scott King to the Judiciary Committee in 1986 during a debate on Jeff Sessions’ nomination to serve as a federal judge.

Here’s the text of Coretta Scott King’s letter that Mitch McConnell didn’t want anyone to hear.

I write to express my sincere opposition to the confirmation of Jefferson B. Sessions as a federal district court judge for the Southern District of Alabama. My professional and personal roots in Alabama are deep and lasting. Anyone who has used the power of his office as United States Attorney to intimidate and chill the free exercise of the ballot by citizens should not be elevated to our courts. Mr. Sessions has used the awesome powers of his office in a shabby attempt to intimidate and frighten elderly black voters. For this reprehensible conduct, he should not be rewarded with a federal judgeship.

I regret that a long-standing commitment prevents me from appearing in person to testify against this nominee. However, I have attached a copy of my statement opposing Mr. Sessions’ confirmation and I request that my statement as well as this be made a part of the hearing record.

I do sincerely urge you to oppose the confirmation of Mr. Sessions.

In a way I am sort of glad Liz Warren was the Dem reprimanded and quieted. She probably has more followers going right now on the Dem side and this should steel her backers and maybe swing some more conservative women into the party. The GOP may have shut up the wrong person politically.

Tennessee prison used ‘Trump’ security stamp on visitors

NASHVILLE, Tenn. (AP) - Visitors entering a Tennessee prison one day last week had the word “Trump” stamped on their hands as they passed through security.

State corrections officials say they don’t know who chose to put the U.S. president’s last name on the stamp at Northwest Correctional Complex in Tiptonville or why, but it won’t happen again.

The president, one of the world’s most renowned real estate developers, is often fond of brandishing his name on his luxury properties.

It’s not clear what he would think about the Trump name being used at a prison.

State Department of Correction spokeswoman Neysa Taylor says that the words on the stamp change daily.

She said prison officials don’t want anyone to be offended and have forbidden proper names being put on stamps in the future.

I said basically the same when Charles first mentioned it here a week or so ago. I hoped he’d get his dumb ass sued by some people that can do him some serious damage.

I don’t know how the law would work, but is there any chance for a group lawsuit? Can many people on that list all join together in a suit. I know there are class action lawsuits against things like a manufacturer or service screwing a bunch of customers. Anything on the defamation, identity theft side?

As I said, the last time a congressional session had me this infuriated was the Palm Sunday Terri Schiavo shitshow—which convinced me to get back involved in politics in a vocal way. That night, I had to run from room to room, from my computer to the TV—tonight all of my rage is confined to a single room.
