GOTV FT

What I want to see if we run the board.

Universal Right to Vote by Mail Act

The Universal Right to Vote by Mail Act (H.R. 1604, S. 3299) is a proposed bill that would “Amend the Help America Vote Act of 2002 to prohibit a state from imposing additional conditions or requirements on the eligibility of an individual to cast a vote in federal elections by mail, except to the extent that it imposes a deadline for requesting the ballot and returning it to the appropriate state or local election official.”.[1] The bill would remove restrictions in 22 states that require specific reasons, such as doctors notes, for voting absentee by mail.[2]

We need a sweeping Voting Rights Act, at the minimum it should include:

1. universal mail vote (including a provision that all ballots must be postmarked by election day and a directive to the USPS to prioritize ballots)
2. universal early voting (at least 14 days)
3. an acceptable ratio of polling places and voting booths per precinct/county
4. Pre-clearance for all states

It’s the Howard Jarvis disciples who want to keep Prop 13.

Hell I remember 1978 when Jarvis & Gann promised renters that if they voted for Prop 13 their rents would go down by 1/3. Instead rents doubled within 4 years.

I’ve come to believe that Prop 13 was as much a byproduct of the high inflation rates we had in the late 70s as it was anything else. And I get it within that context. But today, it is fairly stupid, and has probably contributed to the fucked up housing market we have today.

What a joke.

Covering a different period. The first poll was 10/31-11/1; the second was 11/1-11/2. It would not be surprising given Trump’s constant law and order message, coupled with the recent rioting in Philadelphia, and Joe’s phone experience.

Would like to remind people that whenever a poll shows both candidates under 50% (as is true for many Senate polls), I assume, based on sad experience, that the remaining percentage will likely go to the Republican candidate. So just because a candidate is leading by 4%, if it’s 48(D)-44(R)%, it would not be surprising if it ends up with 52(R) - 48(D). OTOH, I don’t really believe any of these polls anyway, especially those with good news(yes I’m a pessimist, why do you ask?)

Not getting all “skewed polls”, but the pollers seem to be going out of their way to overweight gooper-heavy populations to essentially make sure they don’t get 2016’ed again. Most of my family were Illinois farmers through the depression into the 1980s. My generation cousins all dropped out as farmland went through the roof. Oh wait, there’s that one asshole that married one of my cousins and still farms—absolutely the most condescending prick in the extended family. Anyway, I know it’s not easy work and there are those who really do struggle. But I guess we’re never supposed to ask how all the money from DC gets spent and how things have changed in the last generation.

I still stand by my belief that Biden will exceed his polls in many states. You’ve got a well known and generally liked challenger going against a generally unliked incumbent. It’s a different ball game than 2016. And I’m going to scream that until the EC meets.

Do I wait until tomorrow to put one on my car or do I put it on today and go drive around to show my support? The back of my Vibe still has an Obama/Biden sticker plus stickers in favor of same-sex marriage when that was on the ballot in MN. The Biden/Harris sticker would make a nice addition to the collection. The other sticker on my car is one that I got from the MN DNR long before I worked for them. It does have other meanings for those in the know (although the marriage stickers are a big clue).

I’ve felt that Trump was going to be the most uniquely challenged incumbent of my life because he actually would have to run on something other than “I CAN SOLVE IT ALL.” Just watching Biden and Trump side by side. One is a focused guy who is on message. Yeah he’s a little old fashioned but he gets the point across in an effective manner and he’s forward looking. The other guy? I don’t know what the fuck most of the time. Trump’s a terrible stump speaker. He really benefited from third party turnout last time and lower turnout compared to 2008/12. I also think Biden’s campaign has proven more effective in getting to younger voters. A lot of them may not love Joe but they think he’s all right and that’s all right. We don’t need to Stan the President.

These aren’t people who feel they’ve got a good case in the courts. They’re just throwing shit against the walls.

But with Trump’s incompetent know nothing extremists on the bench, that might be enough…

And that’s too close for comfort, which means that what should normally set up as a landslide feels a lot closer than that.

In ordinary reality/timeline, this would be a blowout of epic proportions with the talk being of a landslide. Instead, we’re worried sick that states might have enough ratfucking/election fraud/voter suppression by GOPers to make it close.

This isn’t close. This should never be close. Trump wrecks nation and economy and kills 300,000+ with his incompetence, and we’re still talking about a few percentage points that might spell the end to the American Experiment.

Fuck this all to hell.

When Biden wins, I echo KGxvi’s calls for a new VRA:

. universal mail vote (including a provision that all ballots must be postmarked by election day and a directive to the USPS to prioritize ballots)
2. universal early voting (at least 14 days)
3. an acceptable ratio of polling places and voting booths per precinct/county
4. Pre-clearance for all states

Make no mistake, the only reason things are close are because the VRA got wrecked by the Supreme Court in Shelby and the GOP refused to update/reform the VRA to comply with the Court’s bulkshit reasoning.

His whole attack on 2009 is “Well it was almost worse” and it’s like yeah asshole that’s why they set up the pandemic response teams all over the world that you fucking ignored. Trump thinks learning from your mistakes is a point of weakness. He has no plan for life after the pandemic because he wants to present a reality that the pandemic has been no big deal. Well it is a big deal. People have died, people have permanent pre-existing conditions, and lots of places went out of business.

Make no mistake, the only reason things are close are because the VRA got wrecked by the Supreme Court in Shelby and the GOP refused to update/reform the VRA to comply with the Court’s bulkshit reasoning.

And no matter what Roberts does. The weaken of the VRA is his legacy.it’s why though past right wing CJs like Burger and Rehnquist were definitely problematic in their own ways that Roberts is worse due to his gutting of VRA. Agree with you and KG, we definitely do need a new VRA.

Yeah I figured he was taking Klain out of context. I’m hoping Klain for Biden’s CoS. I’ve seen Ron in action on social media. He’s an effective communicator and he has Biden’s trust along with the right experience for a CoS. I’m also seeing rumors that Biden apparently isn’t going to consider Senators for the cabinet and I’m cool with that too. We don’t need distractions with special elections or inexperienced interim Senators. Obviously you’ll need one for Harris’ seat but I don’t think Biden needs to fill the cabinet with former Senators.

A very devout Republican friend of mine posted that in FB months ago. That seems to be a common theme among certain members of the Trump base. Of course, it doesn’t apply to those stopping traffic with their “Trump Train” nor those who are intimidating minority voters. But there is a significant segment of the Trump base who can engage in normal conversation as long as you avoid politics. They are the good Germans who are polite and considerate, but have no problems with the evils committed by their Fuhrer, and indeed probably applaud them. But they themselves wouldn’t commit acts of violence against their friends who hold other views.

Same as people who wave a CSA flag and a USA flag side by side. The real CSA had people who went to places like Brazil because they hated the US government so much. There’s even a community in Brazil that is descended from those people. Some went to Mexico too and later fought for Emperor Maximilian as well.

There’s a certain amount of performative acts here by politicians knowing who’d get certain positions and who’d be asked to join an administration.

People like Sanders would be at the top of the pecking order for a committee chair for a powerful position like Budget, VA, or Environment. They get to set Congressional agenda.

But if they go into the Cabinet, they’d have to be replaced by someone, and that can be problematic since the Senate is likely a close 52-48 or thereabout level, and the last thing you want is to give GOP any advantage to undermine Biden’s 1st 2 years in office.

Even if you replace D for D with a D gov or special election, it’d take time for that to happen, and we need to deal with issues with a flying start.

I expect a lot of Cabinet level officials to come from outside the current Congress.

I mean the thing that helps us is that we’re four years removed from controlling the executive branch unlike eight years when Obama took over from W Bush. I agree with you. A lot of the cabinet is going to come from outside elected officials. I do think Mayor Pete will get a spot but that’s because he’s a man without a working position right now and honestly I think Ambassador to the UN is a good one for him. Yeah I’d prefer a little more experience but combine his multilingualism, intelligence, and likability, I think he’d do well at that. I don’t see it being VA because I think something more high profile would be better for Pete. What’s truly great though IMO is a lot of people have multiple jobs they could handle. And honestly what gets underestimated about Kamala Harris is she’s smart on economic issues as well. She made her name in the criminal justice system but she majored in econ at Howard and her dad’s an economist as well. So there’s a lot of people Biden himself included that have multiple specialties they bring with them to the administration.

Same thing with Warren in Massachusetts. Baker could just fill the seat with a genetic Democrat and then run himself in the special election and possibly win. And TBH I think Warren’s better off as a legislator than administrator. That’s not a slight on her. It’s just that I think her skillset, passion, and focus are better in the Senate. Everybody wants a cabinet that’;s like the Dream Team but you actually want some people who are less high profile. It’s why while I favor Doug Jones or Sally Yates for AG, I also wouldn’t be upset if Xavier Becerra who is obviously well known in Ca and even Kamala’s successor got that position as well or if he got her seat. As I’ve said, the great thing is we have a lot of people who have multiple specialties.

That’s right. TBH I just don’t like Bernie as an administrator. I’m not really that big on him as a legislator either but the latter is what he’s been doing. Why give him DOL when you can find someone with just as much progressive bonafides who probably understands the way that department works. Not getting all “skewed polls”, but the pollers seem to be going out of their way to overweight gooper-heavy populations to essentially make sure they don’t get 2016’ed again. Looks to me like the calculation is: you end up too optimistic for Dems, and gooper media threatens your lives; too optimistic for goopers, and Dems forget it and celebrate when they exceed expectations.

I think part of it is “fighting the last war”, the pollsters have (likely over) corrected based on the last results. Which probably isn’t a bad thing in the grand scheme of things.

I still am amused by the decision to make him TX GOP Chair. I checked out who the VA Dem chair. I had never heard of her but she’s someone who has been working for the party since Carter’s re-election and has seen the good times and bad times for the state party. I’m really encouraged by the direction the Virginia Democratic Party has taken. I think the national party can mirror it too. We’re only as strong as our legislative majorities will make us. I keep on saying this but Ralph Northam ideologically is probably the second most conservative Democrat I’ve supported for Governor but he’s also had the most to work with of any Democrat in a long time and a much more liberal legislature. That will be a template for Biden IMO.

You don’t hand your state party when your state is experiencing realignment to a non-native who served a single term in Congress who has until now never worked elections in your state. The problem with the Trump GOP ideologically aside is that it’s all about who can be the most Trumpy and it’s why their problems as a party won’t go away with Trump gone. I’m also not impressed with their youth movement after seeing Madison Cawthorn in Meadow’s old district either. I’m still of the opinion that Sanders isn’t getting a cabinet position because Vermont has a Republican governor who is likely going to be re-elected, which means appointing Sanders to a cabinet position is a loss of a seat in the Senate. So, unless the Dems get a 55 or 56 seat majority, he’s staying where he is.

While social media has really accelerated fact-checking and exposed Trump’s lies, the sad fact is the GOP doesn’t care, because this is what they are. All this assistance from the Lincoln Project and disenchanted folks like Michael Steele has been awesome, but we have to remember that doesn’t change the fact the GOP they’re part of are still largely anti-gay, anti-climate, anti-science, anti-choice, anti-Obamacare, and anti a bunch of stuff that matters. These are the same people that have sat through crazy religious nuts at CPAC conventions and pimped Bush’s policies, gave twits like Palin a thumbs up, and were okay with all of it.

The only difference is they don’t want Trump. They still want all that other crazy shit.

Maybe, deep down, she knows he’s part of the problem and removing him from Congress is a net positive? (I don’t think she actually believes this… I believe it, but that’s because he’s an old school populist and I have no time for populism and its related bullshit)

I dunno. I mean I want someone competent at DOL. I don’t want a grump who is still arguing the labor battles the same way they were when my Grandfather were there from the FDR years through the Johnson years. I want someone who understands modern labor issues. And I don’t think Sanders is that person.

Pete is awesome. I think he’s perfect for UN Ambassador. Definitely someone who could be President one day. He has the right stuff. I just thought he wasn’t ready but he showed a lot of maturity and smarts for someone who just became eligible for the first time this election cycle. It was just a big leap from South Bend to 1600 Pennsylvania but that doesn’t mean he can’t and won’t season his experiences along the way.

I just generally don’t like Sanders, so my view is probably really jaundiced as to just about anything involving him.

As far as the Department of Labor, I’m not even sure what it does… I know it’s the department that houses OSHA, but other than that, I’m drawing a blank.

Also, with respect to the Vermont Senate seat, yes, there’s a special election that must be held within 6 months, but the governor gets to appoint an interim Senator, so that’s 6 months with one extra Republican (who could win the special election), doesn’t make much sense to even temporarily lose a seat.

This is great news - and correct under the law. If you don’t have standing to sue, you can’t bring the case as stated. As others have pointed out, the plaintiff isn’t even a resident of the county where the suit was brought and he purposefully excluded the county where he lives from the same scrutiny on drive-in votes (his county is doing the same exact thing).

The Legum tweet above says this:

Even if the plaintiffs did have standing, the judge says he would still count the votes.

Sounds like he would have ruled the same way no matter what.

And mind you - this judge is one of the guys people were freaking out about over the weekend.

It looks like a lot of them are adhering to law, whether they’re wingnuts or not.

No, Judge Hanen seems to have stated that even if the plaintiffs (GOP) had had standing, he would not have ruled to toss the votes.
Which means the Republicans’ case must have been extraordinarily flimsy: I’d read that Hanen was a thoroughly partisan GOPer.

Today’s rulings are why I’m not sweating the idea that Trump is gonna win this in the courts as much as others have in recent weeks. In order for the USSC to even consider installing him as a dictator, any cases first have to move far enough in the lower courts for the “Nine Wise Souls” (h/t Charlie Pierce) to consider hearing the case. If the Trump campaign/state GOP can’t meet that bar, then there’s no chance he’s gonna steal one or more states.

Way I’m reading Judge Hanen’s remarks is:

- The TX GOP got their hands slapped for lacking standing, in this case showing that counting those votes would constitute “fraud”

- But even if he had ruled there was standing, he still would have allowed the votes to be counted

- That said, he’s ordering drive-thru voting suspended for tomorrow because of the legal vagaries concerning what constitutes a “structure” under TX election laws

- And finally, he’s telling the defendants to keep those votes separate like their PA counterparts are, because it’s almost guaranteed that the TX GOP will appeal to the 5th Circuit and if that court finds that they’ve standing then the votes might still be invalidated. Left unsaid is that the reason for keeping them separate, as PA is doing: The GOP are likely to argue that any mixing of votes means all the votes are “invalid.”

lawhawk  Nov 2, 2020 • 1:04:28pm

The Economist is forecasting that Democrats retake the Senate with average of 52 seats. They also predict with almost 99% certainty that Biden wins the popular vote. They give Trump a 4% chance of winning the EC, which is 5% too much, but that’s how the winner is chosen - EC, not popular vote.

538 is slightly more conservative: They’re giving Biden a 90% chance of winning the EC. 538 is also forecasting that Democrats have 75% of retaking the Senate.

I’ve been ignoring national polling because that doesn’t tell me who wins the EC. It just says sentiment favors the competent guy, not the one who wrecked the economy in the WH right now.

If you haven’t already voted, please do so - in person if you must, mail in via drop off if you haven’t already, and may the odds be in our favor.

The Royal line of succession runs to at least forty individuals, IIRC. It no longer descends uniquely through the male line so any female candidates stand on their own merits rather than only being considered for the Crown if a direct male candidate does not exist (i.e. Elizabeth I). The most recent legal change involving eligibility was that Royals were permitted to marry Catholics and remain in the line of succession.

Ah, but in 2016, they were in 67 jurisdictions; this year, 44. Taking out the ones that are repeats, these are the new ones for 2020—so about 1/2 of this year’s were not monitored in 2016 (I don’t have time right now to check the voting history in each, but it seems very…strange.

Judge Hanen basically told plaintiffs that if they do appeal the ruling on standing to the 5th Circuit and is reversed, he won’t toss the 127K votes under review because state law allows tents for “voting sites.” But he would enjoin drive-thru voting in such a scenario as state law would not allow tents for use as “polling places.”

Oh, and apparently he’s not happy with making this ruling, which shows you just how flimsy the TX GOP’s case is…and how even being a conservative Trump appointee does not mean you can simply ignore the law.

Yeah, the Georgia regular election requires an actual majority or it triggers a run off, so if Ossof only gets 49.9% we could be looking a three run offs. I suspect Iowa, Montana, and South Carolina may end up having recounts or a fully canvasing. I’m also hopeful for Alaska and Mississippi.

I suspect, sadly, Tubberville is going to win in Alabama. But Arizona, North Carolina, Maine, and Colorado should be clear Democratic wins.

Way I figure it is that at least one of the three “must-win” states for Trump (FL, AZ, or NC) will be called for Biden before midnight. The moment that happens, the networks will be stuck trying to think up increasingly implausible scenarios for how Trump might still pull it off. PA will likely have to wait until midday Wednesday, but unless the polls are shockingly off the mark, then that will be called for Biden and there will be no pathway forward for Trump.

re: #278 Belafon

I get texts that say “Can you get three more people to vote?” And my answer is nope, all the ones I want to vote that are around me have. The rest of them I would like to think the election is on Wednesday.

We have a roster to do drive-bys of every polling place in the county. If we encounter problem lines, non-partisan life-support people are called and will show up with goodies. If we encounter assholes, there’s calls for that too. In reality, the weather looks perfect and we’re so red they’re not likely to bother with harassment.

I was actually think the same thing. But interestingly enough, XKCD directly addresses this in the hover text: “You might think most people you know are reliable voters, or that your nudge won’t convince them, and you will usually be right. But some small but significant percentage of the time, you’ll be wrong, and that’s why this works.” As always YMMV.

I’ve nudged all of those around me. All but one of them voted early, and she just has to vote on election day.

Upside to Alabama is that that will free up Doug Jones for a post in the Biden admin.

Past that, it’s not a question of if Trump loses, but how badly the final tally against him will be.

If Biden wins Florida and North Carolina, and the other reliable Democratic states he’ll be over 270. (Edited: tried to include a link to 270towin, didn’t work)

October 29: +140 (new record)
October 30: +76
All cases by age: 20-29 and 40-49 (tied), then 30-39
DEATHS: 16 (no change)

Number of cases has nearly tripled since October 1 (2,457)

Of my neighbors I talked to about an hour ago—a couple and her parents (her father just moved here and I led him through what he had to do to register) have all voted straight Dem. My goofy next-door-neighbor, who is a big Bernie fan and voted for Jill fucking Stein in 2016, voted straight Dem. Two others I know but haven’t seen are definitely voting Dem. One Republican asshole (maybe he won’t vote); two I’m not sure of; one family I don’t know their citizenship status (fairly new arrivals.) So out of a 10-unit condo, 8 Dem already voted; 2 either have or will vote Dem; and the rest I don’t know.

It probably won’t make a big difference here in south by dog Carolina, but it did make me smile, at least for a minute.

538’s interactive map shows that even if Trump “wins” PA, he’d have to win 2/3 of those bellwether states (NC, FL, & AZ) to have a hope of winning outright. But that Biden winning any of them pretty much powers him to a win.

270towin.com just updated to show

Biden: 290
Trump: 163
Toss-up: 85 (no path to victory unless he flips 22 electoral votes and takes the rest from toss ups)

Sabato’s Crystal Ball is shown at 270towin.com projecting:

Biden: 321
Trump: 217

They move toss-ups into one column or the other on the final poll aggregation so there are no toss-ups in their prediction. They put GA, NC, PA, MI, WI, NE-2 and AZ in the Tilt Democratic column.

Well, hurricane season is over. Someone tell Hurricane Eta that, now a Category IV storm at 130mph, and expected to intensify.

After it makes landfall in Nicaragua, it is expected to become a post-tropical depression, recurve through Honduras, and become a tropical depression again as it takes aim at Cuba, still over very warm water.

hurricane season isn’t over until November 30

If the vote margins are as wide as the polls suggest, or anywhere close to it, it’s highly unlikely they will challenge. It’s one thing to rule in a close election, where literally anything could happen; it’s quite another to blatantly rule in an attempt to throw what was obviously a resounding defeat.

Speaking as a MA resident, Charlie Baker has all the charisma of a door knob. I don’t see any future for him in national politics. He won because Martha Coakley was that bad of a candidate. He won reelection because he was competent and inoffensive and the Dems ran another crappy candidate whose name I can’t even remember.

But he is boring.

He isn’t the type for public office. Neither was Coakley. I’d like to see all Republicans out of office in the state, to reflect on their character. I can’t and shouldn’t stop a center-right party from forming, but it will have to commit to ALL civil rights from now on.

re: #205 Yeah Sure WhatEVs

I crave boring.

I do too, but there’s a reason why we speak of “public office”. Baker is required to interact with legislators, and the public. People look to the governor for leadership.

Charlie Baker is just not good at it. He only has office because people here have the mistaken idea that a D legislature and an R governor equal “balance”.

(Interesting side note: Howie Carr is the local hard-right radio host. He refers to Baker as “Tall Deval”, referring to Deval Patrick, the previous African-American governor.)
