Washington Post Reveals Trump Phone Call Threatening and Bullying Georgia Officials to Falsify Election Results

Politics • Views: 16,859

In a sane world this would be cause for immediate impeachment, conviction, and removal from office. It’s what a criminal sounds like when he thinks he’s speaking privately. Trump pressures Georgia’s Raffensperger to overturn his defeat in extraordinary call.

YouTube

President Trump urged fellow Republican Brad Raffensperger, the Georgia secretary of state, to “find” enough votes to overturn his defeat in an extraordinary one-hour phone call Saturday that election experts said raised legal questions.

The Washington Post obtained a recording of the conversation in which Trump alternately berated Raffensperger, tried to flatter him, begged him to act and threatened him with vague criminal consequences if the secretary of state refused to pursue his false claims, at one point warning that Raffensperger was taking “a big risk.”

Throughout the call, Raffensperger and his office’s general counsel rejected Trump’s assertions, explaining that the president is relying on debunked conspiracy theories and that President-elect Joe Biden’s 11,779-vote victory in Georgia was fair and accurate.

Trump dismissed their arguments.

Richard Nixon used to be the worst example of presidential criminality in US history, but Trump makes him look like an amateur.

History has judged the former President to be criminally negligent in the death of thousands of American citizens, morally bankrupt in treatment of immigrants, and vastly amoral in race relations in empowering white nationalism.

With our Criminal Records Room, you can do the research on how YOU would prosecute Trump’s crimes against humanity!

A bunch of people want the same end result as Trump but don’t want to sign on for his reckless tactics.

And a bunch of other people are opposed to this but are scared to stick their neck out because accurately describing how broken are system is undermines the authority they possess because they are veterans of that system.

And the institutions that are supposed to call out and criticize this kind of behavior have been captured by bad faith anti-partisan sentiment, where one must find a formula that attributes blame to all sides regardless the specifics of the wrongdoing.

Trump is a very useful trial balloon for the GOP right now to see how far they can push the legal boundaries in their lust for power. I imagine Karl Rove chomping at the bit to get back in the game armed with this knowledge.

What’s in it for him? What’s in it for Donald Trump? This is why he needs to be removed. Now, you may be asking how much damage can he really do in the next several months until the election? A lot. A lot of damage….

And you know you can’t trust this President to do what’s right for this country. You can trust he will do what’s right for Donald Trump. He’ll do it now. He’s done it before. He’ll do it for the next several months. He’ll do it in the election if he’s allowed to. This is why if you find him guilty, you must find that he should be removed. Because right matters. Because right matters and the truth matters. Otherwise, we are lost.

Trump always projects his crimes and malfeasance on others. He always thinks others are doing these actions because he does them. That’s why he thought Bidens were doing crimes in Ukraine, because that’s exactly what he had been doing. He thought the Bidens engage in nepotism, because that’s all his family has ever known. He thinks Bidens were acting above the law because that’s how Trump has always acted and used/abused the law. Trump never considered the oath of office to mean anything, so he thinks that is what everyone else thinks of it (he’s true to the extent that the GOP doesn’t think anything of their oaths of office either except for a grim handful - grim because there’s so few of them left).

lawhawk  Jan 3, 2021 • 12:06:15pm

Trump interfering in the election in Georgia violates both state and federal law. He should be prosecuted accordingly.

Georgia Statutes: 21-2-597 - intentional interference in election
18 USC 595 - interference in elections.

Both are misdemeanors (up to a year in prison). Multiple counts.

Further, Trump’s actions specifically have targeted minority communities (separate federal crime - misconduct).

All of the following are federal crimes as well:

Fraud by an Elections/Campaign Official or Other Individual:

Changing a ballot tally or engaging in other corrupt behavior as an elections official
Providing a voter with money or something of value in exchange for voting for a specific candidate or party in a federal election
Threatening a voter with physical or financial harm if they don’t vote or don’t vote a certain way
Trying to prevent qualified voters from voting by lying about the time, date, or place of an election (voter suppression)

Trump has attempted to corrupt behavior of election officials in multiple states. This is felony conduct. It’s conspiracy to engage in election fraud, those on the call enabling this behavior are accessories and/or coconspirators. Trump threatening officials to manipulate the tally is felony conduct.

He and his campaign have engaged in felony conduct since before 2016, they didn’t stop. They haven’t stopped since November. This is how a crime syndicate operates and will keep operating until it is disrupted and prosecuted by authorities who are willing to do so.

Yes. Louie Gohmert called for violence just yesterday.

Calling for violence is not sedition. Moreover, it’s not even necessarily incitement in the legal sense (in this case it wasn’t).

“Once you eliminate the impossible, whatever remains, no matter how improbable, must be the truth.” - Sherlock Homes

I am really beginning to suspect that the Epstein murder is at the bottom of this, the one action that could be proven and that Trump and his sycophants cannot weasel their way past. Killing someone in federal custody is normally all but impossible, but the complicity of responsible officials just might make it doable and is the only thing that could. In this case, the responsible official is Barr, who has obviously been sweating bullets himself and may well be willing to turn. Indeed, he may have already done so. There is no other way, period. The only way Trump can stop it is to stay in office with virtually dictatorial powers. Even that is a long shot but it is all he has at this point.
I remember a big jump in GOP crazy just after the Epstein episode. This is the period when the Q cult, which had existed for two years, received a powerful promotional boost from somewhere and was suddenly everywhere. Bannon and his partners could arrange this with the help of the GRU influence network. We also saw a big jump in militia activity, and in the militancy of their rhetoric, with their promotion of Covid democide following as that opportunity presented itself. That these groups are both acting on behalf of the GOP and subject to foreign influence is hardly in doubt. The same can be seen with an even more pliable band of mercenary whores, the big time pulpit pimps.

18 U.S. Code § 2384 - Seditious conspiracy
U.S. Code
Notes
prev | next
If two or more persons in any State or Territory, or in any place subject to the jurisdiction of the United States, conspire to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States, or by force to seize, take, or possess any property of the United States contrary to the authority thereof, they shall each be fined under this title or imprisoned not more than twenty years, or both.

Dependent vs independent clauses.

conspire to overthrow
put down, or
destroy by force,

or

levy war against them
oppose by force the authority thereof,

or

by force

Conspiring to overthrow can be sufficient for sedition. Using force is not a predicate. Actions in furtherance of the conspiracy is sufficient. Actively opposing lawful authority is sufficient. Going after multiple state officials to engage in the disenfranchisement is sufficient.

Moreover, we have GOPers who have called for violence in furtherance of Trump’s effort should he fail to achieve his goals bullying officials and interfering in the election process.

Sure, it would be, if there was an overthrow attempt, which it won’t be, because it won’t be directed against a government (Biden is not govt. until the 20th) and using the constitutional tools does not fall under “overthrow”. So, no sedition.

Using pseudolegal means may even be illegal in other ways, it’s just not sedition as defined in the USC. It may “need” to be treated as such in the future, for such the law needs to be updated; but it cannot be treated as such according to the law on the books.

No, you don’t understand sedition; the only parts not preceded by “by force” don’t have anything to do with the legal objections in the Congress, which do not constitute an overthrow of any existing government.

It’s pretty much impossible to be certain because Trump is just full-time inside his own reality, but…a guess based on his narcissism is that he feels entitled to win in Georgia and is more focused on destroying that source of shame. But one could also read it as a narcissist who believes everything is transactional picking a target he thinks is the easiest to threaten and leverage.

So even if Georgia went along with Trump’s anti-democratic nonsense, he’d still lose. Thank goodness that Trump is such an idiot. We will need to fear the suave, well spoken, nefarious Republican contender that comes on the scene in a few years. He won’t be as dumb and feckless as Trump.

I am optimistic that Trump’s cult of personality won’t readily transfer to a GOP politician. A big part of his appeal is the myth of Trump the self made businessman. Most GOP politicians are just empty suits, as Trump revealed during the 2016 GOP primaries.

There needs to be accountability. There needs to consequences. Outrage alone doesn’t change shit.

Every last one of these motherfuckers should be staring long prison terms in the face, for real. Every one of them.

I am trusting Biden not to interfere in the legal work of the DOJ, like a normal President. The new AG and their team will know this evidence is out there.

Preventing the peaceful transition of government can and should be treated as seditious action. Trying to remain in power despite losing is interfering in the transition of government. Trump’s not using constitutional tools to remain in power. Neither are the GOPers that are trying to disrupt the peaceful transition of power.

Preventing the next president from taking office is acting against out government.

It probably isn’t only Georgia, he has undoubtedly made the same call to the other states he lost.

You are so right. Trump has made numerous calls to various Republican officials around the country in these key states and he’s had legislators to the White House to discuss these election issues. This is the only call that apparently was recorded. The officials elsewhere may have been cooperative. After all several states have fake slates of electors they are proposing as alternatives to the legitimate electors.

So typical. Per Wiki, she decided that the government was too big because her husband was convicted of various fraudulent bank activities and fined three million dollars.. Conservatives support crimes by those who are white and wealthy. The only law and order they favor are laws to suppress the poor and people of color. If one needs any evidence of this, look how Rick Scott parlayed a fine of $1.7 billion for Medicare fraud into a governorship and then a position as Senator. My only surprise is that he didn’t sign on to the Cruz team to object to Biden’s election.

Says the man with the twitter addiction.

Trump: It doesn’t pass the smell test because we hear they’re shredding thousands and thousands of ballots and now what they’re saying, “Oh, we’re just cleaning up the office.” Yeah.

Raffensperger: Mr. President, the problem you have with social media, they — people can say anything.

Trump: Oh this isn’t social media. This is Trump media. It’s not social media. It’s really not it’s not social media. I don’t care about social media. I couldn’t care less. Social media is Big Tech. Big Tech is on your side. I don’t even know why you have a side, because you should want to have an accurate election. And you’re a Republican.

Hilbert: To get to this issue of the personal information and privacy issue, is it possible that the secretary of state could deputize the lawyers for the president so that we could access that information and private information without you having any kind of violation?

Trump: Well, I don’t want to know who it is. You guys can do it very confidentially. You can sign a confidentiality agreement. That’s OK. I don’t need to know names. But on this stuff that we’re talking about. We got all that information from the secretary of state.

Meadows: Yeah. So let me let me recommend, Ryan, if you and Kurt would get together, you know, when we get off of this phone call, if you could get together and work out a plan to address some of what we’ve got with your attorneys where we can we can actually look at the data. For example, Mr. Secretary, I can you say they were only two dead people who would vote. I can promise you there are more than that. And that may be what your investigation shows, but I can promise you there are more than that. But at the same time, I think it’s important that we go ahead and move expeditiously to try to do this and resolve it as quickly as we possibly can. And if that’s the good next step. But hopefully we can we can finish this phone call and go ahead and agree that the two of you will get together immediately.

313
jaunte  Jan 3, 2021 • 2:21:02pm

Trump: Well why don’t my lawyers show you where you got the information. It will show the secretary of state, and you don’t even have to look at any names. We know want names. We don’t care. But we got that information from you. And Stacey Abrams is laughing about you. She’s going around saying these guys are dumber than a rock. What she’s done to this party is unbelievable, I tell ya. And I only ran against her once. And that was with a guy named Brian Kemp and I beat her. And if I didn’t run, Brian wouldn’t have had even a shot, either in the general or in the primary. He was dead, dead as a doornail. He never thought he had a shot at either one of them. What a schmuck I was. But that’s the way it is. That’s the way it is. I would like you … for the attorneys … I’d like you to perhaps meet with Ryan ideally tomorrow, because I think we should come to a resolution of this before the election. Otherwise you’re going to have people just not voting. They don’t want to vote. They hate the state, they hate the governor and they hate the secretary of state. I will tell you that right now. The only people like you are people that will never vote for you. You know that Brad, right? They like you know, they like you. They can’t believe what they found. They want people like you. So, look, can you get together tomorrow? And Brad. We just want the truth. It’s simple.

And everyone’s going to look very good if the truth comes out. It’s OK. It takes a little while but let the truth come out. And the real truth is I won by 400,000 votes. At least. That’s the real truth. But we don’t need 400,000. We need less than 2,000 votes. And are you guys able to meet tomorrow Ryan?

Germany: Um, I’ll get with Chris, the lawyer representing us and the case, and see when he can get together with Kurt.

Raffensperger: Ryan will be in touch with the other attorney on this call, Mr. Meadows. Thank you President Trump for your time.

Some further points about sedition.

Although the Rahman judgment explicitly confirms that “by force” also applies to “overthrow”, this is also confirmed by the SCOTUS cases dealing with sedition and the Smith act, which contains the same language which was argued above to be separable (as in, allegedly “by force” wouldn’t apply to “overthrow”). But notably the judgments (some of which override the others) clearly assume that “by force” applies to “overthrow” too.

supreme.justia.com
supreme.justia.com
supreme.justia.com

Furthermore, the verdict in the Hutaree case (remember them?) shows how hard it is to convict even explicitly murderously violent groups of sedition, the bar being so high.

Preventing the peaceful transition of government can and should be treated as seditious action. Trying to remain in power despite losing is interfering in the transition of government. Trump’s not using constitutional tools to remain in power. Neither are the GOPers that are trying to disrupt the peaceful transition of power.

i’m not a lawyer, but “can and should” are not legal arguments. they’re policy arguments. a judge wants to know if you can demonstrate that the elements of something correspond to the black letter law. otherwise, they’re sending you and your case on its way out the door.
