It’s obvious that the statute I posted is the one that applies in this case. This was NOT a fetus — and this:

Any person who unlawfully, willfully, deliberately, maliciously and with premeditation kills the fetus of another…

Is very clearly not the case. The mother is accused of killing her own newborn baby. So it’s not just wrong — it’s doubly wrong.
