The judiciary isn’t supposed to be a ‘last resort’. They’re supposed to rule on stuff. And there has been plenty of rulings on 4th amendment issues by Kagan and Sotomayor already.

What ‘previous’ civil protections are you talking about? Pen registers have been the law of the land for a long, long time, the FBI has infiltrated group for a long, long time, etc. What period of time do you see a right to privacy being established in the US?

You say that as if the changes the P.A. made don’t matter. They do.
There is broad agreement on this point here right?

For your understanding given your thrice expressed inability to understand my posts- I was talking about the rally, not congress, today not years, and the Patriot Act not some imaginary perfect day from the past for privacy.

The judiciary has been the last resort to end some really bad legislation. Court challenges come after passage not during the shaping of the law. The courts don’t preempt laws, they uphold or end them after a proper legal challenge. Hence the term last resort. It’s about timing, not the level of desperation.
