Out of curiosity, is there more to the Federalist society than a desire to let anti-choice nut jobs eliminate the idea of unenumerated rights, combined with striking down all regulations on big business as somehow infringing on (unenumerated) ‘rights’ of corporations.

With the disclosure that it’s been about a decade since I’ve been deep in those circles…

Most FedSoc members are just attorneys looking to get MCLE credit and/or network. Among those that think about the “big questions” there used to be a decent amount of debate about things like unenumerated rights (Randy Barnett wrote a lot about it back in the day), and there was a real split between conservatives and libertarians on those kinds of issues. I’m not entirely sure how or why it changed in the last decade, perhaps I need to reach out to some people I used to know back then and see).

Probably the strangest thing I remember hearing at a FedSoc event was a speaker talking about repealing the 17th Amendment - all of the law students at my table looked at each other like “wow, that’s crazy.”
