Failure to preserve or present documentation is the original definition of “obstruction of justice”. So if they bring suit, they file for discovery, and Giuliani’s camp says, “Nope, we don’t have any such documents,” and it can be proven that at least some of those records existed from external sources, then Giuliani gets whacked.
