The question is, and I think its at the heart of the case Rogue posted as well… Does an armed, mental disturbed person constitute a threat absent any other actions?

And assuming you’re CC, can you make the threat assessment to shoot-to-kill in that situation? Or do you need to wait to see if the person opens fire (potentially on you) first?

Legally, a lawfully armed citizen does not have to wait for an armed aggressor to fire first. No state requires “Do not fire unless fired upon” because that is simply impractical due the hitting power of modern firearms.
