Lawfare…. first Gitmo terrorists were deemed to have habeas rights. Now, terrorists and detainees in Bagram prison in Afghanistan have been deemed by a court to have habeas rights. That means detainees there have access to US courts (the DC Circuit Court).

This is asinine and throws centuries of law on its head, to say nothing of the fact that US law and US treaties (Geneva Conventions were clear on all of this).

Minor point here, but didn’t that court confine its ruling to prisoners brought into Afghanistan from outside the country……not from the field of battle in Afghanistan?
