It is the Unions legal duty to represent them, they aren’t allowed to pick and choose based on someones acts. All the union can do is guarantee that the employee gets due process, then it is out of their hands.

The unions have no power to prevent a firing, if the firing is reversed by a court, its usually because the employer didnt follow the law in the process.
