Ask the courts, they are the ones that shut down a lot of GW’s plans over constitutional issues. They ruled that they have the right to be charged and defend themselves. Congress could vote to suspend that right in a crisis, but then we’d all lose it.

I don’t buy the ‘then we’d all lose it’ argument. I wouldn’t lose shit. I am an American citizen. The people we’re talking about at Gitmo are not American citizens. If they get the same protections we get then what the hell exactly, is the point in being an American citizen?
