I used to do a lot of DUI work.
You can blow a pretty high number and still seem unimpaired if (and this isn’t a happy “if”) the drinker is habituated. A problem drinker will actually look and perform worse when he is sober then when he is moderately drunk (by BAC standards).
Obviously, if he is a habitual drunk, I don’t want him as a cop, but diagnosing drinkers based on their behavior can be hard.
Or, it’s cops covering for cops. As has happened since the beginning of time.
